E-filing of Service Tax Return

All Service Tax assessees are hereby informed that they will not be able to file ST 3 returns in ACES now and have to wait until the modified version of ST 3 Form is made available in a few weeks. Please revisit ACES website for further information. For details please see What's New Section above. Inconvenience caused is regretted.                   CBEC implements Negative list of Services w.e.f 1-7-2012. The modified Service Tax Registration Form is now available in ACES.                   CBEC proposes to introduce new registration and return forms. LEVY OF SERVICE TAX ON RAILWAY PASSENGERS TRAVELLING IN AC CLASS/FIRST CLASS FROM 1st OCTOBER 2012


The Central Government while introducing the provisions of negative list vide Finance Act, 2012 made the service in relation to transportation of passengers by railways in the first class or an air conditioned coach, taxable. However, the same was exempted up to 30-09-2012 vide the notification no 43/2012-ST dated 02-07-2012. Now, vide Press Release of Ministry of Finance dated 27-09-2012, Service Tax in case of railway travel, which was earlier exempted will belevied on the fare of passenger services in the following classes from 1st October 2012:
(i)           AC First Class,
(ii)         Executive Class,
(iii)       AC-2 tier Class,
(iv)        AC-3 tier class,
(v)          AC Chair Car class,
(vi)        AC Economy class and
(vii)      First Class.

In this regards, vide notification no 26/2012-ST dated 20-06-2012 an abatement of 70% has been permitted on passenger services and accordingly the Service Tax will be charged on 30% of total fare including reservation charge, development charge, and superfast surcharge.

All India Federation of Tax Petitioners (AIFTP) has recommended the Central Board of Direct Taxes (CBDT) for extension of date for income tax return filing this year. It pointed out that the due date on September 30 is a Sunday. AIFTP said CBDT should issue a clarification as it did in 1992.
The half-yearly bank holiday on September 29 also created further problems in payment of taxes, AIFTP said in a release. There are other problems too such as unfamiliarity with introduction of a new Schedule (VI) to the Companies Act and delay in getting digital signature.

“The Chartered Accountants are taking more than the usual time
in auditing the accounts owing to introduction of the Schedule that requires the accounts to be prepared in a new format”,
the tax professionals’ body said. “In many cases where the digital signature is a must, and the validity of such signature has expired or if it is a new return, the authorised dealers are taking considerable time of 2 to 3 days in making allotment of digital signature,” said AIFTP.

It also mentioned that tax payers in flood affected States are facing problems in filing returns.

The Central Board of Direct Taxes (CBDT) today said it has
reduced the time period for tax refunds to three months and would
take steps to release arrear payment as fast as possible.
"We have brought down time for refund...Timing of rectification at
the Central Processing Centre (CPC) level has been brought
down to 3 months and so," CBDT Chairperson Poonam Kishore
Saxena told reporters here.
"Arrears are going to be released. From September 3, we have
started demand correction fortnight. Adjustment would be done in
a short while," Saxena said.
She admitted that due diligence was missing in some cases and the department would try to sort out the problems.
Saxena also said in the last five years, the number of refunds disbursed by the Income Tax India department stood at 35.20
crore, out of which 20.61 crore refunds were done through bank facility.
In the current financial year as on August 2012, the number of refunds disbursed stood 33.51 lakh, out of which 33.15 lakh
refunds were executed through bank facility.
In case of refund bank facility, refund directly goes to account of concern assessee.
Saxena said the target for direct tax collection of Rs 5.70 lakh crore for the current financial year would be met.
"The department is going on massive computerisation drive. We want to be identity blind. Attempts are to reduce
interaction so that grievances are minimised," she said. (

१ जुलाई २०१२ से सिनेमा में काम करने बाले कलाकारों द्वारा प्रदान की जाने बाली सेवाओ को  सेवा कर के दायरे में रखा गया है, अब सिनेमा में काम करने बाले कलाकारों को 12.36% का सेवा कर का भुक्तान करना होगा, सेवा कर में हुए नए बदलाव के अनुसार अब सभी प्रकार की सेवाओ पर जो की नकारात्मक सूचि एवं छूट प्राप्त सूचि में नहीं आते है उनको सेवा कर का भुक्तान करना अनिवार्य होगा, यह सेवा प्रदाता की वैधानिक दयित्व होती है की वह सेवा प्राप्त करने बाले से सेवा कर की राशि को प्राप्त करे और उसका भुक्तान सरकार को करे,

छोटे सेवा प्रदाता को प्रदान को सामान्य छूट प्रदान किया गया है, जो वित्त वर्ष में कुल दस लाख तक की सेवा प्रदान करता है उसे छोटा सेवा प्रदाता कहा जाता है

इस बात को Mr. S S Palanimanickam (Minister of State for Finance) ने राज्य सभा में उठे प्रश्न के अपने लिखित जबाब में दिया है I
